Foreign nationals staying in Russia temporarily will be able to get sick leave benefit

The Russian Ministry of Health has allowed the issuance of sick leave notes to foreign nationals temporarily staying in Russia. Amendments to the procedure for issuance of sick leave notes were introduced by Decree No. 953-n dated November 28, 2017 which entered into force on April 10, 2018.

Previously, foreign nationals could get sick leave notes only if they lived in Russia permanently. No sick leave notes were issued to foreign nationals staying in Russia temporarily, and no sick leave benefits were paid to them either.

Now, medical institutions will be able to issue sick leave notes to foreign nationals staying in Russia for a short period of time. But the payment of benefits will be a more complicated matter as employers will be able to pay the sick leave benefits due to foreign nationals only after social insurance contributions have been paid for such employees for 6 months (Article 2 Federal Law No. 255-FZ).

“The changes made by the Ministry of Health are clearly intended to improve the conditions of foreign nationals, but everything is not as easy as it seems at first glance. The amendments only affect the conditions for issuance of sick leave notes, while the procedure for their payment has not changed. This gives rise to a situation where sick leave notes are issued in hospitals, employees submit them to their employers as justification of their absence, but they cannot receive payments for their sick leave benefits” comments Elena Rybnikova, Head of Internal Audit, Expertise and Methodology Department at Intercomp.

This Ministry of Health decree has also changed the rules for issuance of childcare leave notes, but the procedure for their payment has remained the same.
